Terms of Service

Please read these Terms of Service carefully before using GigPilot. These terms govern your access to and use of the GigPilot platform, including all subscription services and AI-powered features. By using GigPilot, you agree to be bound by these terms.

1. Acceptance of Terms

By accessing or using GigPilot ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these terms, you may not use the Service. This agreement is between you ("User") and GigPilot Inc. ("Company", "we", "us", or "our").

2. Description of Service

GigPilot is an AI-powered DJ booking platform that helps DJs discover gig opportunities, generate pitch messages, track applications, and manage their booking pipeline. The Service is provided via a subscription model with multiple tiers.

3. Eligibility

You must be at least 18 years old and capable of entering into a legally binding contract to use the Service. By using GigPilot, you represent and warrant that you meet these requirements.

4. Subscription Plans & Payment

GigPilot offers four subscription tiers: Starter ($100/month or $1,000/year), Basic ($200/month or $2,000/year), Standard ($300/month or $3,000/year), and Pro ($499/month or $4,990/year). All fees are billed in advance through our payment processor, Paddle (paddle.com). Subscriptions automatically renew unless cancelled at least 24 hours before the renewal date. All sales are final and non-refundable except as required by applicable law. GigPilot reserves the right to modify pricing with 30 days' notice.

5. Billing & Cancellation

Payments are processed securely by Paddle.com, our authorized reseller and Merchant of Record. Paddle handles all billing, invoicing, and tax compliance on our behalf. You may cancel your subscription at any time through your account settings. Cancellation takes effect at the end of the current billing period. No refunds are issued for partial billing periods.

6. AI-Generated Content

The Service uses artificial intelligence to generate gig matches, pitch messages, and booking recommendations ("AI Content"). You acknowledge that: (a) AI Content may not always be accurate or appropriate; (b) you are solely responsible for reviewing, editing, and sending any AI-generated communications; (c) GigPilot does not guarantee any booking outcomes; and (d) you must not use AI Content for misleading, deceptive, or unlawful purposes.

7. User Obligations

You agree to: (a) provide accurate and complete profile information; (b) use the Service only for lawful DJ booking activities; (c) not impersonate any person, venue, or promoter; (d) not attempt to scrape, reverse-engineer, or extract data from the Service; (e) not use the Service to send spam or unsolicited communications; and (f) comply with all applicable laws in your jurisdiction regarding employment, contracting, and music performance.

8. Prohibited Uses

You may not use GigPilot to: (a) violate any local, state, national, or international law; (b) transmit any unsolicited or unauthorized advertising; (c) impersonate or misrepresent your affiliation with any person or entity; (d) interfere with or disrupt the integrity or performance of the Service; (e) attempt to gain unauthorized access to any part of the Service or its related systems.

9. Data & Privacy

GigPilot collects and processes your personal data as described in our Privacy Policy. By using the Service, you consent to this data processing. We use industry-standard encryption and security practices to protect your data. We do not sell your personal information to third parties. We may share anonymized, aggregated data for analytics and service improvement purposes.

10. Intellectual Property

All content, features, and functionality of the Service — including but not limited to software, text, graphics, logos, and AI algorithms — are owned by GigPilot and are protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works of any part of the Service without our express written consent.

11. Third-Party Services

The Service integrates with or links to third-party platforms including Paddle for payment processing, Spotify, SoundCloud, and event listing sites. GigPilot is not responsible for the content, policies, or availability of these third-party services. Your use of third-party services is governed by their respective terms and privacy policies.

12. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTY OF ANY KIND. GIGPILOT EXPRESSLY DISCLAIMS ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT ANY DEFECTS WILL BE CORRECTED.

13. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, GIGPILOT SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, BOOKINGS, DATA, OR GOODWILL. OUR TOTAL LIABILITY TO YOU FOR ANY CLAIMS ARISING FROM THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID TO GIGPILOT IN THE 12 MONTHS PRECEDING THE CLAIM.

14. Termination

Either party may terminate this agreement at any time. You may cancel your subscription through your account settings. GigPilot may suspend or terminate your access immediately if you breach these Terms, engage in fraudulent activity, or violate applicable law. Upon termination, your license to use the Service ceases and GigPilot may delete your data after 30 days.

15. Governing Law & Dispute Resolution

These Terms shall be governed by the laws of the State of Delaware, USA, without regard to conflict of law provisions. Any disputes arising from this agreement shall first be attempted to be resolved through good-faith negotiation. If unresolved within 30 days, disputes shall be subject to binding arbitration under the American Arbitration Association rules. Class action lawsuits are waived.

16. Changes to These Terms

GigPilot reserves the right to modify these Terms at any time. We will notify you of material changes via email or in-app notification at least 14 days before the changes take effect. Your continued use of the Service after the effective date constitutes acceptance of the updated terms.
